Terms & Conditions
These Terms & Conditions apply to all photography, videography, and video editing services provided by the Photographer/Videographer (“the Creator”). They’re here to make sure everyone knows what to expect and to help projects run smoothly.
1. Booking & Payment
Payment terms are 30 days from the invoice date unless otherwise agreed in writing. The invoice due date will always be clearly shown on each invoice. Bookings are considered confirmed once there is written agreement and/or payment (including any agreed deposit).
Shoot and filming times will be agreed in advance as part of the project scope. If the schedule runs beyond the agreed time, additional time will be charged at the Creator’s standard hourly or half-day rate.
2. Late Payment
If an invoice becomes overdue, statutory interest may be charged at 8% above the Bank of England base rate, calculated daily, along with reasonable recovery costs, in line with the Late Payment of Commercial Debts (Interest) Act 1998.
3. Image, Video & Edit Delivery
Final photographs, video files, and/or edited video content are delivered digitally via a downloadable link, unless we’ve agreed something different in advance. Download links are time-limited.
Once files have been downloaded, the client is responsible for saving, backing up, and sharing the files internally.
Any music used in video edits will either be licensed through appropriate music libraries or provided by the client with the necessary usage rights. If a client requests a specific track that requires additional licensing, the cost and responsibility for securing the licence will rest with the client unless otherwise agreed.
The number of final video versions, formats, and aspect ratios (for example 16:9, 1:1, or 9:16) will be agreed as part of the project scope. Additional versions or re-formatted exports requested after delivery may incur an additional editing fee.
Platform-specific compression or processing (for example on social media platforms) may affect final playback quality, which is outside the Creator’s control.
4. File Management, Storage & Project Files
The Creator doesn’t offer long-term file storage, ongoing file management, or uploading assets to client drives or third-party platforms unless agreed in writing.
This also means that RAW image files, unedited video footage, and project files (such as edit timelines or source assets) are not supplied as standard. If download links expire, reissuing or retrieving archived files may be possible at the Creator’s discretion and may be subject to an admin fee.
RAW image files, unedited video footage, and editing project files are not supplied as part of standard delivery. If a client requires access to original or unedited assets, this can sometimes be arranged by separate agreement and may involve an additional licensing and preparation fee.
5. Revisions & Retouching
Unless otherwise agreed in writing, video projects include up to two rounds of revisions, as outlined in the project agreement.
Revisions are intended for refinements such as pacing, sequencing, basic colour correction, and audio balancing. Requests that go beyond the original brief, require significant extra editing time, or involve new footage may be charged at the Creator’s standard rate.
For photography, final image selections may include one round of reasonable retouching adjustments (for example small clean‑ups, colour tweaks, or minor refinements). Any additional retouching requests, significant changes, or further rounds of feedback may be charged at the Creator’s standard rate.
Final retouching will only be applied to the client’s selected images and within the number of images included in the agreed project scope. Additional retouched images can be provided at the Creator’s standard per-image retouching rate.
Feedback on edits or retouching should normally be provided within 7 days of delivery. If feedback is received later than this, additional editing time may need to be scheduled and may be charged at the Creator’s standard rate.
Once a project has been completed and final files delivered, the project is considered closed. Any future re-edits, additional exports, or changes requested at a later date will be treated as a new piece of work and quoted accordingly.
6. Usage & Licensing
Unless otherwise agreed in writing, all photographs, video footage, and edited video content are licensed to the client for their intended use only. Copyright and moral rights remain with the Creator.
The licence doesn’t include resale, transfer, or use outside the agreed scope (such as ATL or paid advertising, broadcast, or third-party distribution) unless this has been agreed in writing. Images may not be uploaded to, or used for the training, processing, or generative synthesis of AI models or similar technologies
The licence granted to the client does not automatically extend to third parties such as partners, sponsors, agencies, or media outlets unless this has been agreed in writing.
The Creator may use the work for portfolio use, self-promotion, competitions, and editorial purposes, unless we’ve agreed otherwise.
7. Credit clause
Where reasonable and appropriate, the Creator appreciates credit when work is published (for example: Photography/Video by Darcie Judson). This is not mandatory but is always appreciated.
8. Cancellations & Rescheduling
Cancellations made within 48 hours of the scheduled shoot, filming date, or editing start date may be subject to a cancellation fee.
If work has already started, the client may be charged for time spent, work completed, and any non-refundable costs. Rescheduling is subject to availability and may involve additional costs.
9. Expenses
Any agreed project expenses (such as travel, accommodation, studio hire, assistants, equipment rental, or location fees) will either be included in the quote or invoiced separately. All additional expenses will be discussed and approved with the client in advance where possible.
10. Acceptance of Terms
By booking the Creator, commissioning photography or video services, or using any delivered images, footage, or edits, the client confirms they have read and agreed to these Terms & Conditions.
